Welcome, we are glad you're here. These Terms and Conditions (“Terms”) act as a legally binding agreement between you and TIC Training Center (officially Opus Marketplace LLC).
In this document, “we,” “us,” or “our” refers to TIC Training Center. “You” refers to the person or entity purchasing or accessing our training services.
Important for Organizations: If you are engaging our services on behalf of a company or organization, “you” refers to that entity, and you represent that you have the authority to bind that entity to this contract. As the Purchaser, you agree to ensure that all individuals you authorize to access the training (your "Authorized Users") follow these Terms.
Important for Individual Students: By accessing our website, you personally agree to be bound by these rules, including the Rules of Conduct (Section 4).
1. Our Training Services
We provide professional training through our website, and you agree to follow our rules when you use it.
What We Offer: We provide multiple courses and educational programs specializing in Trauma Informed Care. We use a platform called LearnWorlds to host these classes.
Our Learning Formats: To meet different needs, we offer our training in two primary formats:
- On-Demand Training: Self-paced lessons you can access at any time.
- Live/Interactive Training: Scheduled sessions that may include real-time instruction or group discussion.
- Note: Your specific course may include one or both of these formats as described on the course enrollment page.
The Different Credentials You Can Earn:
- Certificate of Completion: You get this automatically when you finish a course. It shows you attended and completed the lessons.
- "TIC Practitioner" Designation: This is our proprietary designation for those who master the material. It is a private educational mark, not a government license or a degree.
- Important Note on Accreditation and Credits: We do not pursue accreditation from licensure boards or educational institutions. We do not guarantee that any state board, college, or regulatory body will accept our courses for professional credit. It is your responsibility to check with your specific board or school first to see if they will accept our training.
How Our Grading Works: We want to be clear about how you are graded. Our system uses a fixed mathematical formula (Deterministic Automation), such as having an answer key for multiple-choice questions, to score your quizzes. We do not use "Probabilistic AI" or "Black Box" algorithms to predict or influence your grades. This ensures our grading is objective, transparent, and exempt from high-risk AI regulatory audits.
Human-in-the-Loop & Right to Appeal: While standard quiz scoring is automated, every student has the Right to a Human Review. You may request that a qualified professional review, change, or override any computer-generated score. Additionally, for our "TIC Practitioner" certification, a real person always makes the final decision. This "human-in-the-loop" process ensures your work is reviewed by a human professional, meeting the 2026 standards for automated decision-making transparency.
Your Account: You must be at least 18 years old to use our site. You are responsible for keeping your password safe and for anything that happens under your account name.
System Access & Boundaries: We work hard to keep the site running 24/7. However, our courses are delivered using third-party infrastructure (including but not limited to LearnWorlds, Stripe, Google, Drip, Meta, and Vimeo). We have explicitly delegated "Financial, Delivery, and Email Integrity" to these specialized sub-processors. Our company is solely responsible for "Content and Academic Integrity." We are not liable for outages, delayed emails, or service interruptions caused by these third-party platforms.
2. Intellectual Property & Ownership
We own or have the legal right to use all content in our training. We grant you a limited license to use it for your own learning, but you do not own the materials yourself.
Our Ownership & Licensed Rights: All materials provided through our services—including videos, workbooks, logos, graphics, and the curriculum—are either owned by us or used by us under a valid license from a third party. These materials are protected by United States and international copyright and trademark laws.
Your Limited License: When you purchase a course, we grant you (and your Authorized Users) a non-exclusive, non-transferable license to view and use the materials for personal or internal professional development purposes. This license is limited to the specific individuals authorized to access the training; it does not grant you the right to upload or distribute our content on a company-wide intranet, shared drive, or any other internal network without our prior written permission.
Prohibited Uses: We’ve worked hard to create these materials, and we ask that you respect that effort. To protect our community and our business, the following activities are strictly prohibited without our written permission and constitute a material breach of these Terms.
- Copying, screen-recording, or redistributing our course content or materials in any format.
- Uploading our content to any company intranet, shared drive, or external "knowledge base."
- Using our materials to create competing training programs, derivative works, or for any commercial purpose.
- Extracting data or content from our site using automated means such as "bots," scrapers, or spiders.
- Training, developing, or refining artificial intelligence models or Large Language Models (LLMs) using any of our content.
Trademarks: You may not use our names or logos in a way that suggests we endorse you or your business without a separate written agreement.
Reservation of Rights: All rights not expressly granted to you in these Terms are reserved by us and our third-party licensors.
3. Payments, Subscriptions, and Refunds
We use Stripe for safe payments, and you can cancel any recurring service at any time with just a few clicks.
Safe Payments: We use Stripe to process all payments and we never see or store your credit card number. We have delegated the responsibility for your financial data security to Stripe. While we are not liable for breaches of Stripe’s systems, we promise to notify you quickly if we ever learn that your information might be at risk.
Course Purchases: Most of our trainings are sold as one-time purchases. Once you pay the fee, you will have access to that specific course for the time period stated at checkout.
Subscription Options: If we offer a subscription or "auto-renew" plan, it will renew automatically so you don’t lose access. By signing up for a subscription, you give us express permission to charge your card for each renewal. We will always show you the price and how often you will be charged before you complete your first payment.
Simple Cancellation: You can cancel a subscription at any time through your account dashboard. Our cancellation process is 'Symmetric'—terminating your service is as simple as starting it. We ensure a direct, two-click withdrawal path without mandatory surveys, retention 'saves,' or the requirement to speak with a representative.
Renewal Reminders: For any plan that lasts 6 months or longer, we will email you a reminder 15 to 45 days before your next payment. This follows North Carolina law (GS 75-41).
Your Refund & Withdrawal Rights:
- 14-Day Refund (Including EU/UK Right of Withdrawal): If you have not yet accessed the course content, you have a 14-day "Right of Withdrawal" from the date of purchase to cancel your agreement and request a full refund.
- How to Exercise This Right: Individual students may initiate a request via the Withdrawal Request button located on the first page of their course player. This triggers an electronic notification to our team for manual verification of your purchase method and eligibility. Organizations and Seat Managers, or those preferring manual processing, should submit their request via email to info@traumainformedcaretraining.com. Once verified, we will process your refund to the original payment method and send a formal receipt to your account email.
- Digital Content Rule: Once you stream, download, or start a lesson, the service is considered "used." At that point, you can no longer get a refund, as you have already accessed the proprietary content.
- Live Content Rule (Interactive): For Live/Interactive Training, a session is considered delivered at its scheduled start time. In the event of a statutory withdrawal (EU/UK), any pro-rated refund is calculated based on the number of sessions remaining at the time of your request. Partial attendance of a commenced session does not trigger a refund for that specific unit.
How We Calculate Partial Refunds:
- If your purchase involves multiple items, bulk licenses, or any form of adjusted pricing (such as a bundle, subscription tier, or custom deal), refunds for individual components are calculated proportionally.
- Because the price you paid is often lower than the combined "list price" of the individual items, we do not refund the full list price for a partial cancellation.
- Instead, we determine the refund by looking at the actual total amount you paid and sharing it across the items in your order based on their relative value.
- Relative Value is determined by the standard individual list price of the product as displayed on our public course catalog at the time of your purchase.
- This ensures that any price adjustments or bulk savings are distributed fairly across the entire package.
Withdrawal Rules for Bulk Seats and Licenses:
- For bulk licenses or seat offerings, the 14-day withdrawal right applies only to "unused" seats.
- Once a seat has been assigned to a learner or the content has been accessed, the right to withdraw for that specific seat is waived, as per our Notice at Point of Sale.
- If you cancel a multi-seat plan after a price change, you remain entitled to a pro-rated refund for the rest of your current term if requested within 14 days of the charge.
4. Rules of Conduct & Community Standards
To keep our learning environment safe and fair, you agree to follow these rules when using our site.
One Person, One Account: Your login is for you alone. You may not share your username or password with anyone else. If we detect that multiple people are using one account, we may suspend your access without a refund.
B2B Partial Termination: If you are a company with multiple Authorized Users, we reserve the right to suspend or terminate access for a specific individual who violates these Terms without terminating the entire organization's contract.
Respect the Community: We’re here to learn together! Please be professional and kind in all forums and live calls. We don't tolerate bullying, harassment, or spam.
Keep it Appropriate: To keep our space safe, we do not allow illegal or inappropriate content in any form—whether it’s shared in writing, shown on screen, or spoken during live calls.
No Hacking or Scraping: You agree not to use bots, "scrapers," or any AI tools to automatically download or copy our content. You also agree not to try to bypass our security or "break" our website.
Academic Integrity: We expect all students to complete the coursework honestly. If we determine that you have engaged in academic dishonesty—including but not limited to cheating, sharing answers, or "speed-running" (using automation to skip through videos faster than humanly possible)—we reserve the right to immediately revoke your Certificate of Completion or "TIC Practitioner" designation without a refund.
Your Content (User-Generated Content): If you post a comment or upload a project, you still own it. However, you give us a "non-exclusive license" to display that content within the course so other students can learn from it. You are responsible for ensuring that anything you post doesn't violate someone else's copyright.
Our Right to Terminate: We want everyone to succeed, but we reserve the right to "unenroll" you or delete your account immediately if you violate these rules. If we terminate your account for a "Rule of Conduct" violation, you will not be eligible for a refund.
5. Your Privacy & International Data
We protect your personal information and follow strict global rules when moving data between the US, Europe, and other countries.
How Data Moves: We are a North Carolina company. However, our training platform (LearnWorlds) is based in Europe, and our other tools (like Google Workspace, Stripe, and Drip) are in the US. This means your data often moves back and forth across the ocean.
The "Safety Bridges" We Use: To keep your data legal and safe, we use the EU-U.S. Data Privacy Framework (DPF). As a backup, we also use Standard Contractual Clauses (SCCs). These are pre-approved legal contracts that ensure your data is handled with the same high level of protection no matter where it is stored.
The UK & Brazil Bridges: We follow the strict 2026 updates for global data. For users in Brazil, we rely on the February 2026 EU-Brazil Adequacy Decision, which allows data to move safely between our European platform (LearnWorlds) and Brazil without extra contracts. For users in the UK, we rely on the "Recognised Legitimate Interests" under the UK DUAA to process data necessary for security and fraud prevention.
Global Privacy Control (GPC): We recognize the Global Privacy Control (GPC) signal. While we are working with our platform provider (LearnWorlds) to automate this signal, you have direct control over your data right now. You can update your tracking and cookie preferences at any time by going to Me > Account > Notifications & Privacy in your student dashboard.
No Selling Data: We do not sell your personal information. We only share it with our partners (like Google and Stripe) to provide the training you bought and to answer your questions.
6. Bulk Seat Licenses & B2B Management
If you are making a purchase for a team or organization (“Bulk Purchase”), these additional rules apply to your account.
How the Agreement is Formed: When you pay a Stripe invoice, sign a quote, or complete a bulk checkout on our website, you are officially bound by these Terms. Your access to our platform will be activated once payment is confirmed.
Data Processing for Organizations: Because you are providing us with your employees' information to create their accounts, our handling of that data is governed by our Data Processing Agreement (DPA). By making a Bulk Purchase, you officially acknowledge and agree to the terms of the DPA on behalf of your organization.
Our 'Two-Click' Subscription Promise: In compliance with global standards, any recurring subscription can be cancelled or set to non-renew directly from your administrator’s account dashboard. While stopping future billing is a “self-serve” action, please note that requesting a refund for unused seats or licenses requires pro-rata verification and must be initiated via email as detailed below.
Seat Manager Responsibilities: If you purchase training for an organization and manage seats or licenses for your team (acting as a “Seat Manager”), you are responsible for the accurate invitation of your Authorized Users. You acknowledge that assigning a seat to an Authorized User, or an Authorized User accessing any training content, constitutes “delivery” of the service for that specific seat and waives the right to a refund for that unit. You are responsible for ensuring that all individuals you authorize to access the training follow our Rules of Conduct (Section 4) and Intellectual Property (Section 5) requirements.
One Person, One Seat (Assignment as Delivery): A “Seat” or “License” is a non-transferable unit of access for one specific person; seats cannot be shared or “recycled” between different individuals. Enrolling an individual or an Authorized User accessing any training content constitutes “delivery” of the service for that specific seat. Once a seat is assigned or accessed, it is non-refundable and the right to withdraw for that unit is waived. If we detect multiple people using a single assigned seat, we may suspend that seat or the entire Bulk Account without a refund.
Partial Withdrawals for Organizations: As detailed in Section 3, you may request a withdrawal for unused and unassigned seats within 14 days of purchase. Requests must be submitted via email to info@traumainformedcaretraining.com from the registered purchaser’s email address. Refunds for these seats will be issued on a pro-rata basis, reflecting the actual price paid after all bulk discounts or custom deal adjustments have been applied to the transaction.
7. No Guarantees & Professional Boundaries
This training is for educational purposes only; it is not personal professional advice, and we do not guarantee any specific business, health, financial, or career results.
No Professional Relationship: Using our site or completing a course does not make us your doctor, lawyer, therapist, or personal consultant. We are providing general educational materials only; we are not providing personal professional advice.
Educational Use Only: Everything we teach is meant to help you gain new knowledge, skills, or methods. It is not professional advice. You should always talk to a licensed professional before making big business, health, or legal decisions.
No Earnings Guarantee: We cannot promise that you or your business will make any money using our knowledge, skills, or methods. Your success depends on your own efforts, your background, and the market. Any "success stories" we share are not typical and do not mean you will get the same results.
Professional Licensure & Accreditation: As noted in Section 1, our courses do not grant a degree or government license. We do not pursue accreditation from licensure boards or educational institutions.
Continuing Education (CE): We make no promise that your specific board will accept our training hours for Continuing Education (CE) credits. While some students have used our hours for their professional requirements, this is not a guarantee.
"As-Is" Technology: We work hard to keep our site running smoothly, but we provide our services "as-is" and "as-available." This means we are not responsible if the site goes down, if there are small errors in the content, or if a third-party tool (like LearnWorlds or Stripe) has technical problems
8. Liability, Accessibility & Legal Disagreements
This section explains how we handle disputes and our commitment to accessibility.
Limitation of Liability: To the fullest extent allowed by applicable law, our total responsibility to you is limited to the amount you paid us for the service in the 12 months prior to your claim. However, this cap does not apply to damages caused by our gross negligence or willful misconduct. While these terms are governed by the laws of North Carolina, some jurisdictions do not allow the limitation of liability for certain damages; in those cases, our liability will be limited to the maximum extent allowed by that local law.
Accessibility: We strive to maintain our platform in accordance with WCAG 2.1 Level AA standards. Specifically, we commit to providing synchronized captions and audio descriptions for all video content. If you encounter a barrier, please reach out to our Technical Accessibility Officer, Carl Donovan, at carl@traumainformedcaretraining.com, so we can provide a reasonable accommodation.
Governing Law & Venue: These terms are governed by North Carolina law. Any legal dispute must be handled exclusively in the state or federal courts of Buncombe County, North Carolina.
Individual Resolution: We want to handle any concerns you have directly and personally. By agreeing to these Terms, you agree to resolve any disputes with us on an individual basis. This means you waive the right to join others in a "class action" lawsuit or any similar representative legal proceeding. You are agreeing to bring any claims only as an individual, and not as a member of a group or class.
Changes to These Terms: We may update these Terms to reflect legal or technical changes. Continued use of the site after an update constitutes your agreement to the new Terms.
